The lawsuit not only targets Carroll but also includes the Stafford County General Registrar, the State Board of Elections, and the Department of Elections, indicating the case’s seriousness and potential statewide ramifications.
Restoration News reported that the plaintiffs claim Carroll’s official voter registration lists her at 18 Pinkerton Court, an address they argue she does not actually occupy. Surveillance evidence allegedly shows Carroll and her family continue to reside at her long-term home at 71 Bismark Drive in District 23, where utility bills, vehicles, and personal activity remain tied. The plaintiffs argue this evidence proves Carroll’s candidacy violates the Virginia Constitution, which requires candidates to reside in the district they wish to represent.
According to the Virginia Mercury, Virginia law mandates that voters and candidates establish both a domicile—defined as the locality where a person intends to remain—and a place of abode—defined as the actual physical dwelling. Legal experts note that while these types of challenges are uncommon, they can reshape electoral outcomes if successful, especially when raised during election cycles. In Carroll’s case, a ruling against her would not only disqualify her candidacy but also potentially affect control of the House of Delegates.
