Steve Cortes, founder of the League of American Workers, has expressed concerns over safety in Fairfax County, attributing the situation to District Attorney Steve Descano’s alleged reluctance to prosecute criminals. Cortes highlighted a case involving an illegal alien previously charged with a sex crime against a child who was arrested by U.S. Immigration and Customs Enforcement (ICE) but not prosecuted by Descano.

“Steve Descano has turned Fairfax into a criminal’s playground, refusing to prosecute thugs while families pay the price,” said Cortes. “And now Jay Jones wants to import that reckless experiment statewide? Virginians deserve better.”

According to ICE, agents along with D.C. police apprehended a previously deported Mexican national near the National Mall on August 20. The individual, identified as 35-year-old David Perez-Teofani, faced charges in Fairfax County for felony indecent liberties and aggravated sexual battery of a child under 13. Despite these charges, he was released from custody after local authorities did not honor an ICE detainer request.

“David Perez-Teofani caused a scene by screaming and crying crocodile tears for everyone to see at the scene of his arrest, but we have no sympathy for accused pedophiles and immigration offenders,” said Department of Homeland Security (DHS) Assistant Secretary Tricia McLaughlin. McLaughlin said that Perez-Teofani had illegally reentered the United States after two previous removals and was captured in Fairfax County for suspected sex crimes against a child. She emphasized that under President Trump and Secretary Noem’s leadership, efforts were made to address such issues.

Homeland Security officials reported that Perez-Teofani had repeatedly entered the United States illegally. Records indicate he was first removed to Mexico in 2014 following an expedited removal order and again later that year when he attempted reentry using a stolen U.S. passport. Despite these deportations, he managed to reenter the country and was taken into custody by Fairfax police in January 2024 before being released back into the community.

Fairfax Prosecutor Steve Descano serves as campaign co-chair for Jay Jones, who is challenging incumbent Jason Miyares for Attorney General in Virginia. Miyares has criticized Descano’s approach to prosecution amid rising crime rates in Fairfax County. “Once again, innocent Virginians are being harmed by your inaction and the ‘criminal first, victim last’ mindset that has beset the Fairfax Commonwealth’s Attorney’s Office under your leadership,” Miyares said addressing Descano, according to ABC7 local news.

Cortes is also known as Founder and President of League of American Workers and senior political advisor to CatholicVote. He has served as a senior advisor to President Trump and JD Vance and is recognized as a commentator for Fox News and CNN.
